Overview:


The newly created Florida Gaming Control Commission (“FGCC”) is a five-member commission appointed by the Governor. The FGCC is charged with investigating and enforcing Florida pari-mutuel and gaming statutes and rules.




Position Responsibilities:


The Office of the General Counsel supports every aspect of the FGCC’s operation. Accordingly, the Chief Legal Counsel must be familiar with many areas of the law. These areas include: advising sworn and non-sworn investigators developing cases for prosecution; counseling a state agency regarding taxation, permitting, and licensing issues; analyzing Florida’s public records laws; drafting and defending administrative rules; assisting with procurement and defending against bid protests, litigating cases in the Division of Administrative Hearings, Circuit Courts, and District Courts of Appeal; understanding the interplay between federal and state law; and guiding the development of human resources policies and procedures. Additionally, the Chief Legal Counsel will supervise lawyers and non-lawyer support staff. The Chief Legal Counsel will work under the direction of the General Counsel.




Required Knowledge, Skills, and Abilities:


  • Admission to the Florida Bar and at least 8 years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.

  • At least 6 years of experience supervising lawyers and non-lawyer support staff;

  • Must have a valid driver's license;
  • Skill in drafting legal documents;

  • Skill in managing multiple complex cases;

  • Ability to use Microsoft Word, Outlook and Excel;

  • Ability to prioritize work;

  • Ability to work independently and in a team environment;

  • Ability to communicate effectively;

  • Ability to conduct legal research;

  • Ability to make oral presentations in court and in large groups;

  • Ability to plan, organize and coordinate work assignments;

  • Ability to utilize problem-solving techniques;

  • Ability to work independently;
  • Ability to manage a litigation case load;

  • Ability to recognize and act on emerging issues and shifting priorities;

  • Ability to adapt to changing work volume and variety and work efficiently under stressful situations; and

  • Ability to travel.



Preferred Qualifications:


  • Experience with Florida’s Administrative Procedure Act;

  • Experience with administrative rule challenges;

  • Experience with Florida’s public record laws;

  • Experience with appellate writing;

  • Experience with criminal law;

  • Experience with Florida’s procurement laws; and

  • Experience advising human resource managers.
